Returns & Refunds Policy

1. DEFINITIONS AND INTERPRETATION

1.1 In this Returns and Refunds Policy (“Policy”), the following definitions apply:

a) “Company” means JA Group Services Ltd, a private limited company incorporated in England and Wales.

b) “JA Learning Hub” means the education and training division operated by the Company.

c) “Customer”, “you”, or “your” means any individual or legal entity that purchases Services from JA Learning Hub.

d) “Digital Content” has the meaning given in section 2(9) of the Consumer Rights Act 2015, being data supplied in digital form, including online courses, learning materials, and licences.

e) “Services” means the digital education and training services provided by JA Learning Hub.


1.2 References to legislation include that legislation as amended, extended, or re-enacted from time to time.

1.3 Headings are for convenience only and do not affect interpretation.


2. APPLICATION AND CONTRACTUAL STATUS

2.1 This Policy applies to all purchases of Digital Content and Services made through JA Learning Hub.


2.2 This Policy forms part of the contractual framework governing the supply of Services and must be read in conjunction with:

a) the Terms of Service; and
b) the Privacy Policy.


2.3 By purchasing any Service, you confirm that you have read, understood, and agreed to this Policy.


3. NATURE OF THE SERVICES

3.1 JA Learning Hub supplies digital education and training services only.

3.2 No physical goods are sold, supplied, or delivered.


3.3 Services may include, without limitation:

a) access to online learning platforms;
b) digital learning materials;
c) time-limited or licence-based course enrolments;
d) services delivered via third-party learning management systems.


3.4 Access to Services may be provided immediately or shortly following confirmation of payment.


4. STATUTORY CONSUMER RIGHTS

4.1 Nothing in this Policy excludes, restricts, or limits any statutory rights available to consumers under UK law.

4.2 In particular, this Policy is subject to:

a) the Consumer Rights Act 2015; and
b) the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.


4.3 Where there is any conflict between this Policy and applicable consumer legislation, the legislation shall prevail.


5. RIGHT TO CANCEL UNDER THE CONSUMER CONTRACTS REGULATIONS

5.1 Under Regulation 29 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers generally have a fourteen (14) day right to cancel distance contracts.


5.2 However, pursuant to Regulation 37, this right to cancel does not apply to the supply of Digital Content where:

a) the supply of the Digital Content has begun;
b) the consumer has given express consent to the supply beginning during the cancellation period; and
c) the consumer has acknowledged that the right to cancel will be lost once the supply begins.


5.3 By purchasing Services from JA Learning Hub, you expressly acknowledge and agree that:

a) access to Digital Content may be provided immediately following payment;
b) course enrolment or licence activation constitutes the commencement of supply; and
c) once access has been granted, the statutory right to cancel under Regulation 29 is lost.


5.4 This clause does not affect your rights where Digital Content is not of satisfactory quality, not fit for purpose, or not as described, as provided for under the Consumer Rights Act 2015.


6. RIGHTS RELATING TO FAULTY DIGITAL CONTENT OR SERVICES

6.1 Under sections 34 to 36 of the Consumer Rights Act 2015, Digital Content must be:

a) of satisfactory quality;
b) fit for its particular purpose; and
c) as described.


6.2 Where Digital Content or Services do not meet these requirements, you may be entitled to:

a) repair or replacement; or
b) a price reduction, which may include a partial or full refund, where repair or replacement is not possible or fails.


6.3 Any such remedy shall be applied in accordance with the Consumer Rights Act 2015.


7. REFUND ELIGIBILITY

7.1 Refunds are not automatic and will be considered only in circumstances permitted by law.


7.2 A refund may be issued where:

a) payment has been taken but access to the Service has not yet been provided;
b) a technical or administrative error attributable to the Company prevents access;
c) the Service supplied is materially different from the description provided at the point of sale.


7.3 Refund decisions shall be made in accordance with this Policy and applicable consumer legislation.


8. NON-REFUNDABLE CIRCUMSTANCES

8.1 Subject to statutory rights, refunds shall not be issued where:

a) access to Digital Content has been granted;
b) a course has been accessed, commenced, or downloaded;
c) a licence or enrolment has been issued;
d) the Customer changes their mind after purchase;
e) the Customer fails to complete or engage with the course;
f) dissatisfaction relates to personal preference rather than any failure to meet statutory standards.


8.2 Non-completion of a course does not entitle the Customer to a refund.


9. THIRD-PARTY COURSE PROVIDERS

9.1 Certain Services are delivered via third-party platforms or providers.


9.2 Once a course licence or enrolment has been issued by a third-party provider:

a) the licence is non-transferable;
b) the licence cannot be revoked;
c) refunds may no longer be possible.

9.3 JA Learning Hub acts as a reseller and administrator only and has no authority to override third-party licensing or access rules.


10. REFUND REQUEST PROCEDURE

10.1 Refund requests must be submitted prior to accessing any Digital Content.


10.2 Requests must be submitted in writing to:

10.3 All refund requests must include:

a) the Customer’s full name;
b) the payment or order reference;
c) the name of the Service purchased;
d) a clear explanation of the issue.

10.4 Requests submitted after access has been granted may be refused, subject to statutory rights.


11. REFUND PROCESSING AND TIMESCALES

11.1 Where a refund is approved, it shall:

a) be issued to the original payment method;
b) be processed via the original payment provider;
c) normally be completed within five to ten (5–10) working days.


11.2 The Company is not responsible for delays caused by banks or payment service providers.


12. INCORRECT CHARGES AND PAYMENT ERRORS

12.1 If you believe you have been charged incorrectly, you must notify the Company without undue delay.

12.2 The Company will investigate genuine errors and take appropriate corrective action where required.


13. AMENDMENTS TO THIS POLICY

13.1 The Company reserves the right to amend this Policy at any time.

13.2 The version of this Policy in force at the time of purchase shall apply to that transaction.
